Your use of www.PlanningIreland.com (hereinafter defined as “THE SITE”) is subject to our legal terms. Please read these carefully. Reproduction of this site, in whole or in part, in any form or medium without express permission from Commercial Information Company Ltd (hereinafter defined as “CIC”) is prohibited.
- i. In these Conditions the following words shall have the following meanings: "SERVICE" means the service to be provided by CIC (registered in Northern Ireland under company number NI14532) who are contracted to supply planning information from both Northern Ireland and the Republic of Ireland for the Subscriber as referred to in the registration form. "SUBSCRIBER" means the person or legal entity that CIC has agreed to provide the service in accordance with these Conditions. "CHARGES" means the current annual subscription fee shown on this site relating to the Service.
- ii. The headings in these Conditions are for convenience only and shall not affect their interpretation.
- iii. The site will record all persons or legal entities accessing tender information. Any person or legal entity accessing or using the site is deemed to consent to such recording.
Supply of the Service
- i. CIC shall provide the Service to the Subscriber subject to these Conditions and any set forth in the registration form.
- ii. The Service shall be provided in accordance with the details set out herein and otherwise in accordance with CIC’s current product portfolio or other published literature relating to the Service from time to time, subject to these Conditions.
- iii. Further details about the Service, and advice or recommendations about its provision or utilisation, which are not given in CIC’s current product portfolio or other published literature, may be made available on written request.
- iv. CIC may correct any typographical or other errors on the site or other document relating to the provision of the Service without any liability to the Subscriber.
- v. CIC may at any time without notifying the Subscriber make any changes to the Service which are necessary to comply with any applicable statutory or other requirements, or which do not materially affect the nature or quality of the Service.
Charges
- i. Subject to any special terms agreed, the Subscriber shall pay CIC Charges and any additional sums, which are agreed between CIC and the Subscriber for the provision of the Service.
- ii. CIC shall be entitled to vary the Charges from time to time provided that such variations shall not affect those Subscribers who have already paid for the Service
- iii. All Charges quoted to the Subscriber for the provision of the Service are exclusive of any Value Added Tax, for which the Subscriber, if registered within the United Kingdom, shall be additionally liable at the applicable rate.
- iv. CIC provide a secure office based method for the processing of credit card payments. Subscribers may also opt to pay for the Service via pro-forma invoice.
- v. All Subscriber payments either via credit card or invoice will be processed by the accounts department at CIC.
- vi. In the event that the Subscriber's credit card is declined and / or there are problems processing the card then the Subscriber shall be notified by telephone as soon as practicable.
- vii. Where invoice is sent payment is required by return or subscription will be terminated.
Copyright
- i. The data content is protected by; COPYRIGHT CIC 1989 ISSN 0955-4106, CIC 1992 ISSN 0966-4791 and CIC ISSN 0959-1737. No part or parts of the data may be stored in a separate retrieval system or reproduced or transmitted in any form of by means electronic, mechanical, reprographic, recording or otherwise now known or to be devised.
- ii. The information contained in the Site is for the sole use of the Registered Subscriber, the subscription cannot be transferred for use by any other individual, person or company and the information cannot be used to act on behalf of any third party agents.
Terminations
- i. CIC may (without limiting any other remedy) at any time terminate the Subscription by giving written notice to the Subscriber if the Subscriber commits any breach of these Conditions and (if capable of remedy) fails to remedy the breach within 30 days after being required by written notice to do so, or if the Subscriber goes into liquidation, or (in the case of an individual or firm) becomes bankrupt, makes a voluntary arrangement with his or its creditors or has a receiver or administrator appointed.
General
- i. These Conditions (together with the terms, if any, set out herein) constitute the entire agreement between CIC and the Subscriber, supersede any previous agreement or understanding and may not be varied except in writing between the above parties. All other terms and conditions express or implied by statute or otherwise are excluded to the fullest extent permitted by law.
- ii. Any notice required or permitted to be given by either party to the other under these Conditions shall be in writing addressed to the other party at its registered office or principal place of business or such other address as may at the relevant time have been notified pursuant to this provision to the party giving the notice.
- iii. No failure or delay by either party in exercising any of its rights under the Contract shall be deemed to be a waiver of that right, and no waiver by either party of any breach of the Contract by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.
- iv. If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.
- v. Should the Service be cancelled curtailed or adversely affected by any cause not within the reasonable control of CIC including but not limited to war, fire, labour dispute, Act of God or for any reason CIC shall be under no obligation to refund all or part of the sums paid by the Subscriber in respect of its participation in the Service and shall be under no liability to the Subscriber or any other person in respect of any action proceedings claims demands losses (including consequential losses) costs or expenses whatsoever which may be brought against or suffered or incurred by the Subscriber as a result thereof.
- vi. The Site may contain links to other websites, which may be owned and operated by third parties. If you choose to use the services provided by those websites, you may be asked by those sites to provide certain personal information. CIC is not responsible for the content, terms and conditions, disclaimer notices or privacy practices of those websites. Please read all of the necessary terms of each and every website that you visit.
